Arasan Complex LLP, hereinafter referred to as the “SPA Complex”, offers paid services and goods on the Internet to any individual or legal entity, hereinafter referred to as the “Client”.

In accordance with Art. 395 of the RK Civil Code, this Offer shall be a public offer (hereinafter — the “Agreement”), the complete and unconditional acceptance of the terms and conditions of which shall, as per Art. 396 of the RK Civil Code, be deemed to be the Client’s performance of implicative actions — clicking on the “I agree to the Rules” button located on the SPA Complex’s Website.

 

  1. TERMS AND DEFINITIONS 1. Site — web-portal of the Complex —www.arasan-spa.kz;
  2. The SPA Complex — Arasan Complex LLP (“Arasan Wellness & SPA”);
  3. Ticket — a strictly accountable document sold to the Client by using the system certifying the conclusion of the Agreement between the SPA Complex and the Client, which entitles the Client to receive Services;
  4. Ticket Code — a unique digital code sent to the Client when purchasing a ticket, which shall be provided by the Client at the ticket office of the SPA Complex;
  5. Ticket validity period — a period of time, during which the Client shall be entitled to use a ticket for the SPA Complex’s Services. A ticket shall be valid within 30 (thirty) calendar days of its purchase;
  6. Goods — goods sold by the SPA Complex and indicated on the SPA Complex’s site in the “Goods” Section;
  7. Services — services provided by the SPA Complex specified on the SPA Complex’s Site in the “Services” Section;
  8. “Client” – a natural or legal person aged who has reached the age of 18 years (or accompanied by adults) and accepted an Offer.

2. SUBJECT OF THE AGREEMENT

2.1 The SPA Complex undertakes to provide an opportunity for the Client to purchase Goods and Services of the SPA Complex through the Internet.

3. RIGHTS AND OBLIGATIONS OF THE SPA COMPLEX

3.1. The SPA Complex shall maintain confidentiality of the Client’s information received from him in purchasing Goods and/or Services except as provided by the current legislation of the Republic of Kazakhstan;

3.2. A ticket purchased by the Client on the SPA Complex’s Site shall be returned on the basis of a written request from the Client. Should the ticket be expired, the funds shall not be refundable.

3.3. Within fourteen days of the transfer of non-food goods to the Client, the purchased Goods shall be exchanged at the place of the purchase for similar goods of a different size, shape, overall dimensions, style, coloring, configuration and the like, or for other goods by agreement of the parties. In case of a difference in the price, the required recalculation shall be made with the Client. The SPA Complex shall ensure the exchange or return of non-food goods of a proper quality, if they have not been in use, and if their marketable condition, consumer properties, seals, labels as well as the document confirming the actual purchase of the goods have been preserved.

3.4. The SPA Complex shall, at their own discretion, be entitled to establish a limit on the number of Services and/or Goods available for the purchase by the Client. The exact level of the limit shall be specified by the SPA Complex directly on the page of a specific type of Services and/or Goods on the SPA Complex’s Site. The Client shall be entitled to purchase the number of tickets in excess of the established limit by the prior written agreement with the Complex. In this case, the SPA Complex shall be entitled to deny the Client the purchase of the number of tickets exceeding the established limit without giving reasons.

3.5. The SPA Complex shall be entitled to change the conditions of this Agreement unilaterally at any time, while ensuring the posting of the changed conditions on the Site.

  1. RIGHTS AND OBLIGATIONS OF THE CLIENT

4.1. The Client shall be solely responsible for the safety of the code of the purchased ticket. 4.2. The Client shall be entitled to return its electronic ticket if the period from the purchase thereof is not more than 30 (thirty) calendar days.

4.3. When purchasing tickets at the “Children’s” or “Pension” tariffs, the Client shall have supporting documents by him at the time of presenting his electronic ticket at the ticket office. In the absence of the relevant documents, the SPA Complex shall be entitled to cancel the tickets purchased by the Client returning the appropriate sums to the Client.

4.4. When purchasing Goods and/or Services, the Client shall familiarize himself with the “Payment Information” posted on the SPA Complex’s Site.

4.5. By making payments for the Goods and/or Services, the Client hereby acknowledges that he has read the ‘Rules for visiting a bath” posted on the site.

4.6. The Client shall ensure the accompaniment of minor children under the age of 16 years.

4.7. As required by Art. 36 of the Law of the Republic of Kazakhstan “On a child’s rights in the Republic of Kazakhstan”, the SPA Complex sells no tickets at the “Children’s” tariffs ending after 10-00 p.m.

  1. FORCE MAJEURE

5.1. The parties shall be relieved from responsibility for non-performance or improper performance of their obligations under the Agreement for the period of force majeure. Force majeure shall mean extraordinary and insurmountable circumstances that prevent the PARTIES’ performance of their obligations hereunder. They shall include acts of God; exposure to a nuclear explosion, radiation (ionizing radiation) or a radioactive contamination from nuclear weapons materials, industrial and scientific research or radioactive waste; war, military invasion, hostilities of a foreign enemy, military operations, military maneuvers and related military activities; civil war, armed rebellion, riots of all kinds whatsoever, mass disorders, violent seizure or violent retention of power; epidemics, epizootics, weather conditions, terrorist acts, strikes, seizures, confiscations, requisitions, nationalization etc. A party hereto, for which the above circumstances have occurred shall notify the other party of such occurrence as soon as possible. Well-known events shall not need any confirmation, and in relation to other events, the relevant supporting documents shall be attached, which may be, including but not limited to, documents from the authorized state bodies.
